refers to Lush Limited and "you", "your", "yours"
means you the individual.

business, including the provision of our Lush Kuwait website and our Android
and iOS mobile applications and the products and services we offer, including
through our website, app
and any of our stores. It also sets out how and why we use
personal data, who we
disclose it to, and how we protect your privacy. It also sets out your
rights in relation to
your personal information.

you read this Privacy Notice together with any other Privacy Notice, Terms and
Conditions of Sale, Terms of Use or fair processing notice we may provide on
specific occasions when we are collecting or processing personal data about
you, so that you are fully aware of how and why we are using your data. This

Who Is Responsible for Your Personal Information?

Handmade Cosmetics LLC, a company registered in Kuwait under licence number 2007/627.
For the purposes of applicable data protection laws, we are the "data
controller". "Data controller" is a legal term used to describe
the person or entity that controls the way your personal information is
processed. If you have a query about the use of your personal information, you
may contact our Data Privacy Team by using the contact information at the end
of this Privacy Notice.

Data We Collect From You
4.1 Personal data, or
personal information, means any information about an individual from which that
person can be identified. It does not include data where the identity has been
removed (anonymous data).
4.2 We limit the amount
and type of personal information that we collect to that which is necessary for
the purposes for which we are collecting it.
4.3 Although the precise
details of the personal information collected will vary according to the
specific purpose for which we are collecting the information, we may typically
collect the following personal information from or in relation to you:
Identity Data includes
first name, last name, title, date of birth, username or similar identifier.
Contact Data includes
billing address, delivery address, email address and telephone numbers and
Social Media handle.
Medical Data may be
gathered in our spas as part of your treatment consent form. This may include
information regarding existing health conditions and whether or not you are
pregnant.
Transaction Data
includes details about payments to and from you and other details of products
and services you have purchased from us.
Technical Data includes
internet protocol (IP) address, your login data, browser type and version, time
zone setting and location, browser plug-in types and versions, operating system
and platform and other technology on the devices you use to access this
website.
Profile Data includes
your username and password, purchases or orders made by you, your interests,
preferences, feedback, survey responses and the content of any messaging you
send using the live chat function on the website.
Recruitment Data,
including copies of right to work documentation, references and other
information included in a CV or cover letter or as part of the application
process.
Usage Data includes
information about how you use our websites, products and services.
Marketing and
Communications Data includes your preferences in receiving marketing from us
and our third parties and additional communication preferences.
4.4 We also collect, use
and share Aggregated Data such as statistical or demographic data. Aggregated
Data may be derived from your personal data, but is not considered personal
data in law, as this data does not directly or indirectly reveal your identity,
rather it is anonymous. For example, we may aggregate your Usage Data to
calculate the percentage of users accessing a specific website feature.
However, if we combine or connect Aggregated Data with your personal data so
that it can directly or indirectly identify you, we treat the combined data as
personal data, which will be used in accordance with this Privacy Notice.
4.5 We do not
intentionally collect any Special Categories of Personal Data about you (this
includes details about your race or ethnicity, religious or philosophical
beliefs, sex life, sexual orientation, political opinions, trade union
membership, information about your health and genetic and biometric data)
through our website or Apps. Nor do we collect any information about criminal
convictions and offences.
4.6 Where we need to
collect personal data by law, or under the terms of a contract we have with you
and you fail to provide that data when requested, we may not be able to perform
the contract we have or are trying to enter into with you (for example, to
provide you with goods or services). In this case, we may have to cancel a
product or service you have with us, but we will notify you if this is the case
at the time.

personal information within the Lush Group, including Lush Manufacturing, Lush
Retail, Lush Digital and Lush Limited. This might also include any third
parties who buy, sell, transfer, or merge with parts of our business or our
assets.
7.2 We may use other
carefully selected companies, agents, or contractors (Third Parties) to perform
services on our behalf or to assist us with the provision of services to you,
where we have a legal basis to do so. Some examples of these are:

IT companies that support our website and other business systems
2.
Operational companies such as delivery couriers.
3.
Direct marketing companies that help us manage our electronic
communications with you.
4.
Data insight companies to ensure your details are up to date and
accurate.

For fraud management, we may share information about fraudulent or

exact purposes we specify in our contract with them. In addition, if we stop

and the GCC, for the purposes of providing services to you or supporting our
business operations. If we do transfer your personal information to these
organisations, we will provide appropriate measures and controls to protect
your personal information, such as data transfer agreements in accordance with
applicable law, including the use of Standard Contractual Clauses (SCCs) and
relevant adequacy decisions.

appropriate security measures to prevent your personal data from being
accidentally lost, used or accessed in an unauthorised way, altered or
disclosed. These include:

9.3 At the end of that
retention period, your data will either be deleted completely or anonymised,

resolve matters of concern, including, if necessary, amending our policies and

your request is manifestly unfounded or excessive, we reserve the right to
